What is the NYS MWBE Program?

The New York State Minority Business Enterprise (MBE) program aims to promote economic opportunities for minority and women-owned business enterprises (WBE) in the state. The program sets goals for state agencies, authorities, and commissions to award a certain percentage of contracts to certified minority and women-owned business enterprises (MWBEs).

To be eligible for certification, a business must be at least 51% owned, operated, and controlled by individuals who are minorities or women. The program provides various benefits to certified MBEs & WBEs, including access to contracting opportunities, technical assistance, and networking opportunities. It seeks to address disparities in contracting opportunities and promote diversity and inclusion in state procurement processes.

    The business must be independent and not significantly reliant on another firm for its operations, management, or finances. It should operate as a separate legal entity with its own assets, employees, and business relationships.

  • Size Standards

    The business must meet the size standards established by the certifying agency. These standards may vary depending on the industry and are typically based on factors such as annual revenue, number of employees, or other measures of business size.

  • Good Standing

    The business must be in good standing with applicable licensing, regulatory, and tax authorities. This includes maintaining any required business licenses, permits, and certifications.

  • Principal Place of Business:

    The business must have its principal place of business located within the geographic area covered by the certifying agency. Some agencies may also require that a significant portion of the business's operations occur within this geographic area.

  • Ethical Standards

    The business and its owners must demonstrate ethical conduct and integrity in their business practices. This may include disclosing any past criminal convictions, civil judgments, or other legal issues that could impact the business's eligibility for certification.es here

  • Legal Structure

    The business must have a legal structure recognized by the certifying agency, such as a sole proprietorship, partnership, corporation, or limited liability company (LLC).
